Sintesi Omnilex

A.X. sought revision of a Federal Court judgment that had not entered into his wife's constitutional complaint for lack of standing. The Federal Court held that a nullity complaint under Art. 268 BStP was inadmissible against its final judgment and that the filing could not be treated as a revision request because no procedural defect under Art. 136 OG or new fact under Art. 137 OG was invoked. In addition, the applicant had not been a party to the earlier proceedings and lacked standing to request revision. The Court therefore did not enter into the request and charged him CHF 300 in court costs.

Massima Omnilex

Art. 136 OG, Art. 137 OG, Art. 156 OG; revision of a final Federal Court judgment and standing to seek it. A filing cannot be treated as a revision request where none of the statutory revision grounds is invoked. Revision is reserved to persons entitled to seek it, namely those participating in the challenged proceeding or otherwise legally entitled; a third party lacking procedural participation has no standing. A nullity complaint under Art. 268 BStP is not admissible against a final Federal Court judgment. If the revision request is not entered into, court costs are borne by the applicant (consid. 2-3).

Urteil vom 7. Januar 2003
I. Öffentlichrechtliche Abteilung

Bundesgerichtspräsident Aemisegger, Präsident,
Bundesgerichtsvizepräsident Nay, Bundesrichter Fonjallaz, Gerichtsschreiber Störi.

A.X.________, Gesuchsteller,

gegen

Staatsanwaltschaft des Kantons Luzern, Zentralstrasse 28, 6002 Luzern,
Obergericht des Kantons Luzern, II. Kammer, Postfach, 6002 Luzern.

Revision des bundesgerichtlichen Urteils vom 29. November 2002 (1P.504/2002).

Das Bundesgericht zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Gesuchsteller, der Staatsanwaltschaft des Kantons Luzern und dem Obergericht des Kantons Luzern, II. Kammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the filing could be treated as a revision request against the Federal Court judgment of 29 November 2002.

Decisione estratta

It could not be treated as a revision request because the applicant did not invoke any procedural defect under Art. 136 OG or any new fact under Art. 137 OG.

Motivazione estratta

A nullity appeal under Art. 268 BStP was unavailable since the prior Federal Court judgment was final and could only be set aside by revision. The applicant was not a party to the challenged judgment and therefore lacked standing to seek its revision.

Questione giuridica chiave

Who bears the costs of the revision proceedings?

Decisione estratta

The applicant bears the court costs.

Motivazione estratta

Because the request was not entered into, costs were imposed on the unsuccessful applicant under Art. 156 OG.
