The appellant withdrew his appeal to the Federal Supreme Court after the cantonal appellate decision in a land-reallocation dispute concerning the taxation of a wooded strip. Ein Anspruch auf Parteientschädigung entfällt mangels obsiegender Gegenpartei bzw. besonderer Voraussetzungen (Art. 68 Abs. 3 LTF).

la décision prise par la Commission cantonale de recours en matière d'améliorations foncières du canton de Fribourg le 14 novembre 2008 rejetant un recours interjeté par A.________ contre une décision de la commission de classification du Syndicat d'améliorations foncières d'Autigny du 14 juin 2008 relative à la taxation de la valeur d'un cordon boisé,
le recours formé le 17 décembre 2008 auprès du Tribunal fédéral par A.________ contre cette décision,
la lettre du 27 janvier 2009 du recourant, annonçant le retrait du recours au Tribunal fédéral;
considérant:
qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause du rôle (art. 32 al. 2 LTF, 71 LTF et 73 PCF);
qu'en raison des motifs évoqués dans la déclaration de retrait, il sied exceptionnellement de statuer sans frais judiciaires (art. 66 al. 1 2e phrase in fine et al. 2 LTF);
qu'il n'y a pas lieu d'allouer des dépens (art. 68 al. 3 LTF);
par ces motifs, le Juge unique ordonne:

La cause est rayée du rôle par suite de retrait du recours.
2.
Il n'est pas perçu de frais judiciaires ni alloué de dépens.
3.
La présente ordonnance est communiquée au recourant, au Syndicat d'améliorations foncières d'Autigny, à la Direction des institutions, de l'agriculture et des forêts et à la Commission cantonale de recours en matière d'améliorations foncières du canton de Fribourg.
