Sintesi Omnilex

The Federal Supreme Court did not enter into the appeal against the Solothurn administrative-court judgment on driver’s licence revocation. It held that the appellant’s filing contained only general criticism and failed to show, in a legally sufficient manner, why the challenged decision was wrong. Because the defect was obvious, the matter was disposed of in simplified procedure. The appellant was ordered to pay CHF 300 in court costs.

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 Abs. 1 BGG; requirements for a reasoned appeal and simplified non-entry. An appeal to the Federal Supreme Court must, in an argument directed to the contested grounds, indicate concretely why the decision violates law; merely general criticism or a blanket disagreement is insufficient. In cases of manifest non-compliance with the pleading requirements, the Court may decline to enter into the appeal under the simplified procedure. Costs follow the outcome pursuant to Art. 66 Abs. 1 BGG.
