X.________ filed a complaint against his detention without enclosing the challenged decision or naming the authority against which he was proceeding. After the Federal Supreme Court asked him to submit the decision, he refused delivery of the letter. The court held that the formal defect under Art. 42(5) BGG had not been cured and, in simplified proceedings under Art. 108(1)(a) BGG, did not enter into the appeal. Given the circumstances, no costs were charged.

Art. 42 Abs. 5 BGG; Art. 108 Abs. 1 lit. a BGG; form requirement for the appeal and consequence of an uncured defect: if the appellant fails to enclose or identify the challenged decision and does not remedy the deficiency within the set period, the Federal Supreme Court may decline to enter into the matter in simplified proceedings. A party lodging an appeal must ensure that official correspondence can be served after filing; refusal to accept service does not cure the defect. Costs may exceptionally be waived under Art. 66 Abs. 1 BGG where the circumstances so justify.

Urteil vom 6. Januar 2011
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Fonjallaz, Präsident,
Gerichtsschreiber Bopp.

Verfahrensbeteiligte
X.________, Beschwerdeführer.

Gegenstand
Beschwerde gegen Inhaftierung etc.

In Erwägung,
dass X.________ mit Eingabe vom 29. Dezember 2010 beim Bundesgericht Beschwerde u.a. gegen seine Inhaftierung führt;

dass er es unterlassen hat, zusammen mit seiner Beschwerde auch einen Entscheid einzureichen bzw. die Behörde zu nennen, gegen den bzw. die er sich zur Wehr setzen will;

dass das Bundesgericht den Beschwerdeführer mit Schreiben vom 30. Dezember 2010 aufgefordert hat, den Entscheid einzureichen, gegen den die Beschwerde sich richten soll;

dass der Beschwerdeführer die Annahme dieses Schreibens verweigert hat;

dass er nach allgemeinen prozessualen Grundsätzen gehalten gewesen wäre, nach erhobener Beschwerde dafür zu sorgen, dass ihm behördliche Akte zugestellt werden können (vgl. etwa BGE 130 III 396 E. 1.2.3 S. 399);

dass der Beschwerdeführer den genannten Mangel im Sinne von Art. 42 Abs. 5 BGG somit nicht behoben hat und demzufolge auf die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. a BGG nicht einzutreten ist;

dass es sich bei den gegebenen Verhältnissen rechtfertigt, keine Kosten zu erheben (s. Art. 66 Abs. 1 BGG);

wird erkannt:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer und der Strafanstalt Lenzburg schriftlich mitgeteilt.
