Sintesi Omnilex

The Federal Supreme Court held that the challenged cantonal order was an interlocutory decision that did not terminate the criminal proceedings. The prerequisites for an immediate appeal under Art. 93 BGG were not met, and the complaint also failed to satisfy the substantiation requirement of Art. 42(1) BGG. In simplified proceedings, the court did not enter into the complaint and ordered the complainant to pay CHF 500 in court costs.

Massima Omnilex

Art. 93 BGG, Art. 42 Abs. 1 BGG; admissibility of an appeal against an interlocutory criminal procedural order. A decision that does not terminate the proceedings is an interlocutory decision within the meaning of Art. 93 BGG. Such a decision is only appealable if the statutory conditions of Art. 93 Abs. 1 BGG are met. In addition, the appeal must meet the specific substantiation requirement of Art. 42 Abs. 1 BGG by indicating, in a reasoned manner, how the contested decision violates federal law. If these requirements are not fulfilled, the Federal Supreme Court does not enter into the appeal in simplified proceedings (Art. 108 Abs. 1 BGG); costs are borne by the unsuccessful party (Art. 66 Abs. 1 BGG).

Urteil vom 6. Januar 2010
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Pfäffli.

Parteien
X.________, Beschwerdeführer,

gegen

Generalprokuratur des Kantons Bern, Maulbeerstrasse 10, Postfach 6250, 3001 Bern.

Gegenstand
Strafverfahren,

Beschwerde gegen die Verfügung vom 3. November 2009 des Obergerichts des Kantons Bern, Anklagekammer.
In Erwägung,
dass der Untersuchungsrichter 1 des Untersuchungsrichteramtes III Bern-Mittelland mit Antrag vom 16. Juli 2009, welcher mit Zustimmung des Prokurators 1 der Staatsanwaltschaft III Bern-Mittelland vom 27. Juli 2009 zum Beschluss erhoben wurde, auf die Strafanzeige von X.________ vom 13. April 2009 nicht eingetreten ist;
dass X.________ dagegen bei der Anklagekammer des Obergerichts des Kantons Bern rekurriert hat;
dass die Anklagekammer des Obergerichts des Kantons Bern mit Verfügung vom 3. November 2009 den Antrag des a.o. Generalprokurators zum Rekurs X.________ zur Kenntnisnahme zugestellt hat;
dass X.________ mit Eingaben vom 12. und 21. Dezember 2009 Beschwerde in Strafsachen gegen die Verfügung der Anklagekammer des Kantons Bern vom 3. November 2009 erhoben hat;
dass es sich bei der angefochtenen Verfügung nicht um einen Endentscheid im Sinne von Art. 90 BGG, sondern um einen Zwischenentscheid im Sinne von Art. 93 BGG handelt, da er das Strafverfahren nicht abschliesst;
dass die Voraussetzungen von Art. 93 Abs. 1 zur Anfechtung eines solchen Zwischenentscheides offensichtlich nicht gegeben sind, weshalb bereits aus diesem Grund auf die Beschwerde nicht einzutreten ist;
dass die Beschwerde im Übrigen auch die Begründungsanforderungen von Art. 42 Abs. 1 BGG nicht zu erfüllen vermag, da aus ihr nicht hervorgeht, inwiefern die angefochtene Verfügung Recht im Sinne dieser Bestimmung verletzen sollte;
dass somit im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG auf die Beschwerde nicht einzutreten ist;
dass entsprechend dem Verfahrensausgang die Gerichtskosten dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);
erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.

Questione giuridica chiave

Court costs

Decisione estratta
