Dominik Imhof sued Reveillac, Bardol Cie. for compensation allegedly caused by blasting in the construction of the Gotthard railway. The contractors argued that the matter belonged before the federal expropriation authorities. The Federal Court held that the claim was not based on expropriation or temporary rights taken for a public work, but on an alleged unlawful property damage claim against the contractors. Jurisdiction therefore lay with the cantonal courts, and the appeal was dismissed.
Expropriation law; competence for compensation claims arising from public works versus ordinary tort claims; the federal expropriation authorities are competent only where the claim is grounded in a lawful expropriation or temporary interference with private rights in the execution of a public work. Where damages are claimed against contractors for allegedly unlawful negligent destruction of property, the action is ex delicto and falls within the jurisdiction of the cantonal courts (consid. 1).
Bardol Cie. darstelle, welche sich bei ihren Sprengarbeiten einer Fahrlässigkeit schuldig gemacht haben, da sie es unterlassen, die Barake des Rekursbeklagten durch einige, leicht anzubringende, Schutzvorrichtungen zu schützen. Die Forderung richte sich nicht gegen die Gotthardbahngesellschaft, es handle sich dabei nicht um die Abtretung von Privatrechten und das Bundesgesetz über Ver bindlichkeit zur Abtretung von Privatrechten sei also auf dieselbe überall nicht anwendbar. Es werde daher auf Abweisung des Rekurses unter eventueller Kostenüberbindung angetragen. Das Bundesgericht zieht in Erwägung:
