The Federal Court held that health-care costs may form part of the debtor’s subsistence minimum in wage garnishment, and a temporary increase is possible for imminent medical expenses. But an invoice for dental treatment already completed before enforcement is merely an existing debt and cannot be deducted under Art. 93 SchKG. The lower court must therefore exclude the CHF 220 item and recalculate the minimum subsistence amount.
Art. 93 SchKG; subsistence minimum in wage garnishment and health-care expenses; only expenses actually arising during the garnishment period may be taken into account. The debtor’s necessary maintenance includes health-care costs, and a flat allowance or temporary increase may be justified for imminent medical outlays. By contrast, a claim for treatment already performed before the enforcement measure constitutes a pre-existing debt and cannot reduce the attachable income. In recalculating the minimum subsistence amount, the authority must therefore disregard such prior liabilities (consid. 1).

Aus den Erwägungen:
Zum Notbedarf des Schuldners und seiner Familie gehören auch die notwendigen Aufwendungen für Gesundheitspflege.
Es wird denn auch üblicherweise ein zu deren Deckung bestimmter pauschaler Betrag in den normalen Notbedarf eingerechnet (vgl. die Aufstellung über die Zusammensetzung des normalen Zwangsbedarfs bei ELMER, Die Bestimmung des pfändbaren Lohnes auf den 1. Januar 1959, Seite 3; DES GOUTTES, De la quotitité insaississable im Journal des Tribunaux, 1950, Poursuite p. 66 ff.). Für unmittelbar bevorstehende Barauslagen für Arzt, Arzneien, Geburt usw. darf billigerweise der Notbedarf vorübergehend erhöht werden (ELMER, a.a.O. 15). Aus diesem Gesichtspunkt lässt sich aber die Hinzurechnung von Fr. 220.-- ("Faktura Zahnarzt neue Prothese") zum jährlichen Notbedarf, laut der vorliegenden Pfändungsurkunde, nicht rechtfertigen. Es handelt sich hier nicht um einen Aufwand für erst noch bevorstehende zahnärztliche Hilfe, sondern um eine vor dem Pfändungsvollzug erfolgte Behandlung, wofür Rechnung gestellt war, also um eine bereits bestehende Schuld. Diese darf nach dem wahren Sinn von Art. 93 SchKG nicht abgezogen werden. Es fällt nur der während der Lohnpfändungsdauer erwachsende Notbedarf in Betracht. Die Vorinstanz wird somit bei der ihr obliegenden neuen Notbedarfsbemessung den erwähnten Posten wegzulassen haben.
