Nach der Rechtsprechung des Bundesgerichtes hat der Richter, der die Scheidung ausspricht, von Bundesrechts wegen zugleich auch die Nebenfolgen zu regeln; höchstens für die güterrechtliche Auseinandersetzung darf er eine Ausnahme machen (BGE 77 II 18ff., Urteil vom 6. Juli i.S. Leimgruber, BGE 80 II 5 ff.). Die in den eben angeführten Entscheiden dargelegten Erwägungen, die das Bundesgericht zu dieser Auffassung führten, gelten in entsprechender Weise auch für den Fall der Trennung. Wie ein Scheidungsurteil muss daher ein auf Trennung lautendes Urteil unter Vorbehalt der güterrechtlichen Auseinandersetzung alle Nebenfolgen ordnen. Dieser Schluss drängt sich um so mehr auf, als es dem Zweck der Trennung, im Verhältnis der Ehegatten eine Beruhigung herbeizuführen, geradeswegs zuwiderliefe, wenn während der Trennungszeit noch über die Nebenfolgen der Trennung prozessiert werden müsste. Auch die güterrechtliche Auseinandersetzung, die nötig wird, wenn nach Art. 155 ZGB die Gütertrennung angeordnet wird, ist daher wenn immer möglich im Trennungsurteil zu regeln.

Mit diesen aus dem Bundesrecht sich ergebenden Grundsätzen hat sich die Vorinstanz in Widerspruch gesetzt, indem sie die Trennung aussprach und die Sache zur Regelung aller Nebenfolgen (insbesondere auch der Kinderzuteilung und der damit zusammenhängenden Fragen) an das Bezirksgericht zurückwies. Die Berufungen beider Parteien sind daher in dem Sinne gutzuheissen, dass das angefochtene Urteil aufgehoben und die Sache zur Neubeurteilung an die Vorinstanz zurückgewiessen wird. Will diese im Hauptpunkt an ihrer bisherigen Auffassung festhalten oder kommt sie etwa zum Schlusse, dass das Scheidungsbegehren des Klägers begründet sei, so hat sie entweder selber ein die Trennung bezw. Scheidung aussprechendes und zugleich die Nebenfolgen ordnendes Urteil zu erlassen oder (was ihr durch das Bundesrecht nicht verwehrt wird) die Sache zur Ausfällung eines solchen Urteils an das Bezirksgericht zurückzuweisen.
