Aus dem Tatbestand:

Gaudy beging während der ihm vom Obergericht Zürich auferlegten Probezeit vorsätzlich Unzucht mit Kindern und wurde deswegen vom Obergericht von Appenzell A.Rh. zu einer bedingt vollziehbaren Gefängnisstrafe verurteilt. Er ficht den Vollzug der vom Obergericht Zürich bedingt aufgeschobenen Gefängnisstrafe unter anderem mit der Begründung an, seit der Revision des Strafgesetzbuches von 1950 ziehe ein während der Probezeit vorsätzlich begangenes Verbrechen oder Vergehen nicht mehr zwingend den Vollzug der bedingt aufgeschobenen Strafe nach sich.

Erwägungen

Aus den Erwägungen:

Die Strafe ist auch dann vollziehen zu lassen, wenn dem Verurteilten für das während der Probezeit begangene neue Verbrechen oder Vergehen wiederum der bedingte Strafvollzug zugebilligt worden ist. Diese gesetzliche Regelung, die schon bisher galt (BGE 70 IV 108), hat durch die Gesetzesrevision von 1950 keine Änderung erfahren. Die Revision hat zwar zu der Lockerung geführt, dass der Richter nunmehr ermächtigt ist, in besonders leichten Fällen an Stelle des Strafvollzuges eine der in Art. 41 Ziff. 3 Abs. 2 StGB aufgeführten Ersatzmassnahmen treten zu lassen. Für Fälle wie den vorliegenden, wo diese Voraussetzung nicht zutrifft, hat der Gesetzgeber auf eine Abschwächung des zwingenden Charakters der Ziff. 3 Abs. 1 aber bewusst verzichtet und damit gewollt an der alten Ordnung festgehalten (vgl. Botschaft des Bundesrates vom 20. Juni 1949, BBl 1949 I S. 1249). Von einer Gesetzeslücke, die der Richter ausfüllen könnte, kann daher entgegen der Ansicht des Beschwerdeführers keine Rede sein.
