Eggimann challenged the Zürich authorities' measures concerning her guardianship. The district council had refused to lift the guardianship, while the cantonal justice directorate lifted it but replaced it with assistant guardianship. The Federal Court held that Eggimann had not exhausted the ordinary cantonal remedies and therefore could not proceed with her appeal. As a consequence, the district council's cross-appeal against the lifting of guardianship also lapsed under Art. 59(4) OG.

If the main appeal is inadmissible, the cross-appeal falls away by operation of law. Der Bezirksrat Zürich wies das von der Vormundschaftsbehörde der Stadt Zürich unterstützte Gesuch der Frau Eggimann um Aufhebung der für sie bestehenden Vormundschaft ab. Die Justizdirektion des Kantons Zürich, an die Frau Eggimann rekurrierte, hob die Vormundschaft auf, stellte Frau Eggimann dagegen "im Sinne von Art. 395 Ab. 1 Ziff. 1 ZGB" unter Mitwirkungsbeiratschaft. Das Bundesgericht tritt auf die Berufung, mit der Frau Eggimann die vollständige Wiederherstellung ihrer Handlungsfähigkeit verlangte, mangels Erschöpfung der ordentlichen kantonalen Rechtsmittel nicht ein (vgl. hiezuBGE 67 II 205f. und den vorstehenden Entscheid i.S. Hiestand) und stellt fest, dass infolgedessen die gegen die Aufhebung der Vormundschaft gerichtete Anschlussberufung des Bezirksrates Zürich dahinfalle.
