The Federal Court upheld the complaint of a woman domiciled in Horgen against a Willisau arrest order for reimbursement of poor relief. It held that Art. 58 BV does not regulate venue, but Art. 59(1) BV requires a defendant with fixed domicile to be sued at that domicile for a purely personal claim. The respondent did not prove that the appellant was insolvent or otherwise unable to rely on the constitutional forum. The district court’s competence decision and the arrest order were therefore annulled as unconstitutional.
Art. 58 BV; Art. 59 Abs. 1 BV: jurisdiction and domicile forum in a purely personal civil claim. Art. 58 BV merely prohibits unconstitutional exceptional courts and contains no venue rule. Under Art. 59 Abs. 1 BV, a person with fixed domicile must be sued at the domicile for personal claims, unless the opponent proves by conclusive facts that the person is not solvent/standing. A mere assertion that the defendant previously received public assistance does not establish present insolvency. Lack of knowledge of the domicile at the time of arrest does not alter the constitutional forum (consid. 1-2).
59 Abs. 1 der Bundesverfassung schon deßhalb nicht berufen, weil sie keineswegs aufrechtstehend, sondern notorisch insolvent sei, wie sich daraus ergebe, daß sie theils persönlich, theils in direkt durch Unterstützung ihres unehelichen Sohnes Karl Armen unterstützungen empfangen habe, wie durch liquide Beweismittel dargethan werde. Der Anspruch auf Rückerstattung fraglicher Armenunterstützungen entspringe aus Art. 60 des luzernischen Armengesetzes; nun bestreite Rekurrentin nicht nur das Maß, sondern die Thatsache der Unterstützung; darüber sei aber nach 62 des luzernischen Armengesetzes vom Civilrichter zu ent scheiden. Der zuständige Civilrichter in Arrestsachen sei nun aber der Richter des Arrestortes. Demnach werde beantragt:
