J. Frei challenged the mass administrator's decision ranking his CHF 459 contractual compensation claim in the VII class and requested first-class treatment as liquidation costs. The Federal Court dismissed the recourse. It held that liquidation costs under Art. 38 No. 1 only cover claims arising during the liquidation, whereas Frei's claim predated it. The court also distinguished earlier case law on expropriated land, explaining that those claims arose during liquidation because the estate had to acquire title to the land in order to sell the railway.
Art. 38 Ziff. 1 des Bundesgesetzes betreffend die Zwangsliquidation der Eisenbahnen; Abgrenzung der Liquidationskosten von vorbestehenden Forderungen. Als Liquidationskosten sind nur solche Ansprüche zu behandeln, die erst mit oder während der Liquidation entstehen. Eine bereits vor Eröffnung der Liquidation bestehende Entschädigungsforderung für vertraglich gestattete Materialablagerung auf fremdem Boden gehört daher nicht in die erste Klasse. Frühere Entscheide über Entschädigungen für expropriiertes Land sind nicht einschlägig, wenn die Masse an dem Grundstück kein Eigentum erwerben muss, sondern lediglich eine bestehende Forderung zu liquidieren hat.
