Renggli challenged the refusal of Luzern authorities to let him enlarge and raise a house extending beyond the building line, or alternatively to begin expropriation of the affected terrain. He relied on the cantonal constitutional guarantee of property. The Federal Court held that the building-line regime and the postponement of compensation until actual expropriation were lawful statutory limitations on ownership. Since only an encroachment on the substance of property triggers compensation, the refusal did not violate the cantonal constitution. The complaint was dismissed.
Art. 9 Luzernische Staatsverfassung; building-line restrictions and deferred compensation for land reserved for public streets and squares: statutory limitations on the use of property do not, as such, infringe vested rights. The content of ownership is determined by objective law; the legislature may regulate or alter the powers attached to property in light of public needs without compensation, provided that the substance of the property is not taken. A building line may therefore bar non-essential alterations to existing structures extending beyond it, while indemnity for reserved land becomes due only upon actual expropriation (consid. 1-2).
