Schindler, a former tenant of the Rigistaffel-Kulm inn, complained to the Federal Court against enforcement steps in Schwyz for rent and wine claims after moving to Biel. He argued that a later settlement novated the rent debt and that Art. 59 BV barred proceedings outside his domicile. The court held that the rent claim was secured by a pledge on the furnishings, so Art. 59 did not apply, and that the March 1879 valuation was only a continuation of enforcement validly begun in September 1878 while he still lived in Schwyz. The complaint was dismissed.
Art. 59 BV; secured claims and continuation of enforcement after change of domicile; a claim protected by a statutory or contractual pledge on movables does not fall under the personal forum safeguard of Art. 59 BV. Where enforcement was validly commenced while the debtor was still domiciled in the original canton, a later domicile change does not deprive the cantonal authorities of competence for subsequent enforcement acts. Objections such as payment, waiver, or other grounds suspending the debt enforcement do not concern local jurisdiction and must be raised before the competent cantonal debt-enforcement authority (consid. 1-3).

D. Weber und Hediger trugen auf Abweisung der Beschwerde an, im Wesentlichen aus folgenden Gründen:
