Sanierung von Hotelunternehmungen. N° 48. abzielende Unterhandlungen. Das Vorbringen solcher erst nachträglich eingetretener Tatsachen wird durch die Rechtskraft des früheren Entscheides nicht ausge- schlossen, und' es ist daher auf die Prüfung der Frage einzutreten, ob diese Tatsachen geeignet seien, die Sanierbarkeit. der finanziellen Verhältnisse des :Rekur- renten darzutun. Dabei kann jedoch nicht der gleiche Masstab angelegt werden, wie wenn es sich um ein erstes Gesuch um Eröffnung des Pfandnachlassver- fahrens handelte, m. a. W., es genügt zur Eröffnung des Verfahrens nicht, dass die neu vorgebrachten Tat- sachen gewisse Zweifel erwecken. ob die frühere Fest- stellung der Unsanierbarkeit auch jetzt noch zutrifft. Vielmehr muss hiefür zum mindesten verlangt werden, dass sich die Sanierbarkeit aus den neu vorgebrachten Tatsachen in schlüssiger Weise ergibt, und dass diese Tatsachen nllndestens glaubhaft erscheinen. Dies des- halb, weil sich sonst der Schuldner. gestützt auf eine bloss behauptete Veränderung der Verhältnisse, dem Zugriff der Gläubiger immer wieder erneut zu entziehen vermöchte, auch wenn die Unsanierbarkeit in Wahrheit fortbesteht. 48. eiliträchtigt, wenn der sog. Bauplatz überbaut werden sollte. Stellt dieser demnach in der Tat einen ( ökono- misch untrennbaren . Wertbestandteil des eigentlichen Hotelgrundstückes dar, so ist er, obwohl er für sich allein betrachtet nicht als Hotelgrundstück angesehen werden kann und auch nicht etwa mit dem Hotel zusammen verpfändet ist, nach dem Vorschlag der Schä- tzungskommission doch in das Pfandnachlassverfahren einzubeziehen. 2. -Der mit dem Hotel zusammen verpfändete Stall in Ilanz dient dem Hotelgewerbe des Schuldners in keiner Weise. Allein deswegen darf er doch nicht schlechtweg vom Pfandnachlassverfahren ausgeschlos- sen werden, weil dies dazu führen würde, dass er allein für die gesamte Pfandforderung der Bündnerischen Kreditgenossenschaft in Anspruch genommen werden könnte, was mit An", 816 Abs. 3 ZGB im Widerspruch stünde. Anderseits . aber darf er auch nicht ohne wei- teres in das Pfandnachlassverfahren einbezogen werden, weil es nicht angeht, den Hypothekargläubigern durch das Pfandnachlassverfahren den Zugriff auf andere als Hotelgrundstücke zu versagen, nachdem das Pfand- nachlassverfahren ausdrücklich auf Hotelgrundstücke beschränkt worden ist. Aus diesem 'Viderstreit der interessen kann nur die analoge Anwendung des Art 833 ZGB führen, und es ist demgemäss die Pfandhaft der beiden mitverpfälldeten Grundstücke für die For- derung der Bündnerischen Kreditgenossenschaft der- art zu verteiien, dass sie (unter Berücksichtigung der im Range vorgehenden Belastungen) nach ihrem Werte verhältnissmässig belastet werden. Sollte alsdann die Gläubigerin dieser vom Sachwalter vorzunehmenden Verteilung nicht zustimmen, so würde freilich nichts anderes übrig bleiben, als dass der Stall, mindestens in Bezug auf die Forderung der Bündnerischen Kre- ditgenossenschaft. ebenfalls in da;; Pfandnachlassver- fahren einbezogen wird, sofern wenigstens die Nach-
