Jos. Renggli brought the Federal Court a denial-of-justice complaint after Lucerne authorities had refused to pursue his criminal complaint against his nephew Johann Renggli for perjury. The Federal Court held that no denial of justice occurred: the Obergericht was not shown to have acted beyond its competence, and the lower criminal authorities were entitled to discontinue the prosecution for lack of sufficient grounds. The complaint was dismissed as unfounded, and the complainant was ordered to pay a court fee of CHF 25.
Art. 40 St.R.V.; denial of justice and refusal to continue a criminal complaint: supervisory authorities are not bound to forward every penal complaint to the courts. They may suspend or refuse prosecution where, on the file, no sufficient indications exist that the accused committed the alleged offense. A denial of justice is excluded where the complainant does not substantiate the alleged incompetence or the asserted pretextual nature of the suspension. The Federal Court will not intervene merely because the complainant disagrees with the evidentiary assessment; it examines only whether the refusal of further proceedings lacks any legal basis (consid. 1-2).

Die Kriminal- und Anklagekammer des Kantons Luzern machte in ihrer Vernehmlassung, in welcher sie auf Abweisung der Beschwerde antrug, darauf aufmerksam, daß nach dem lu zernischen Verantwortlichkeitsgesetze Beschwerden gegen das Ober gericht wegen Rechtsverweigerung beim Großen Rathe angebracht werden müssen und daher die Beschwerde verfrüht sei. In ma terieller Hinsicht wurde bemerkt, daß eine weitere strafrechtliche Verfolgung des Joh. Renggli offenbar so wenig zu einem Re sultate geführt hätte, als dies bei der Untersuchung gegen Mag dalena Banz der Fall gewesen sei. Das Bundesgericht zieht in Erwägung:
