Seitz challenged the Schwyz authorities' refusal to enter a criminal complaint for alleged patent infringement and the related adhesive civil claim against Albert Siegel. The Federal Court held that any alleged violation of the federal Patent Act or the Swiss-German patent treaty had to be pursued by cassation complaint under the OG, not by state-law appeal. Because that remedy was available and was not used in time, the state-law appeal was inadmissible. The court also declined to examine the constitutional access-to-courts argument, since the underlying refusal had become final.
Art. 182 OG; Art. 160 ff. OG; Art. 184 Abs. 1 OG: Where a decision alleged to violate federal law is open to cassation complaint, the state-law appeal is excluded, since the Federal Judiciary Act does not permit cumulative or alternative federal remedies for the same grievance. The decisive criterion is the availability of the cassation remedy, not whether the party actually uses it. If no timely cassation complaint is filed, the contested cantonal refusal remains in force; ancillary objections depending on that refusal become devoid of object and are not examined.
Kantonsgericht zur Beurtellung zivilrechtlicher Streitigkeiten wegen Nachahmung patentierter Gegenstände kompetent sei. B. Gegen diesen Beschluß der Justizkommission hat der Re kurrent die staatsrechtliche Beschwerde ans Bundesgericht ergriffen mit dem Antrag, es sei derselbe aufzuheben und es sei das Be zirksamt Schwyz zu veranlassen, auf die Strafklage des Rekur renten gegen Albert Siegel und die adhäsionsweise gestellte Zivilklage einzutreten und die verlangte Strafuntersuchung an Hand zu nehmen.
