A creditor, Moser, objected to the enforcement office’s granting of a wife’s attachment participation without prior execution. The cantonal supervisory authority declined jurisdiction, holding that the objection had to be brought by judicial action. On recourse, the Federal Supreme Court confirmed that under Art. 111 SchKG the creditor’s contestation of the wife’s attachment participation is to be resolved in court, not through the complaint procedure. This also includes objections to the admissibility of the privilege after marital property separation under cantonal law. The recourse was dismissed.
Art. 111 SchKG; contestation of the wife’s participation in an attachment; judicial action, not supervisory complaint. The creditor’s objection under Art. 111 SchKG is not to be examined by the enforcement supervisory authorities, but must be brought before the competent court by action. The statutory contestation procedure is not confined to disputes over the existence or marital character of the claim; it also encompasses other objections directed against the admissibility of the requested attachment participation, in particular where the creditor denies the privileged status of the wife’s claim under the relevant cantonal matrimonial-property rules. Whether the privilege survives separation of property is therefore a matter for the court in the Art. 111 procedure (consid. 2).
nisse handle. Es sind vielmehr in diesem gerichtlichen Verfahren auch andere Einwendungen zu erörtern, die sich gegen die Zu lässigkeit der verlangten Anschlußpfändung richten (s. Jäger, Com mentar, Note 10 zu Art. 111). Hieher gehört speziell auch der vorliegende Fall, wo darüber zu entscheiden ist, ob eine unbe strittenermaßen aus dem ehelichen Verhältnisse entsprungene Forderung auch nach eingetretener Gütertrennung der Ehe gatten der durch Art. 111 vorgesehenen privilegierten Stellung (Teilnahme ohne vorherige Betreibung) teilhaftig sei. Diese Frage ist übrigens wesentlich eine solche des kantonalen Rechtes, indem ihre Beantwortung davon abhängt, in welchem Umfange und unter welchen Voraussetzungen der Kanton Baselstadt von der bundesgesetzlich eingeräumten Befugnis, die Forderungen er wähnter Art zu privilegieren, Gebrauch gemacht hat. Daß Rekurrent nicht in der Lage gewesen sei, den Anspruch der Frau Binder zu bestreiten, wird von ihm nicht behauptet. Demnach hat die Schuldbetreibungs und Konkurskammer erkannt: Der Rekurs wird abgewiesen.
