Hermann Wehrli, a creditor, requested seizure of the debtor A. Rusterholz's Zurich business patent in order to force him to abandon the trade and capture the refundable part of the patent fee. The Betreibungsamt Zürich III and the cantonal supervisory authorities rejected the request. On federal appeal, the court held that the patent is a non-transferable personal authorization and cannot itself be attached. Nor could a contingent refund claim be seized, because there was no basis to assume or compel the debtor's surrender of the patent. The appeal was dismissed.
Art. 89 ff. SchKG; seizure of a Zurich business patent and of the refund claim arising upon surrender of the patent: the business patent is a personal, non-transferable public-law authorization linked to the holder and thus not an attachable asset as such. Nor may a merely contingent claim against the State be seized where it depends on the debtor's voluntary abandonment of the trade; enforcement law provides no basis to compel such abandonment in order to enlarge the seizure fund.

Allein es liegt nichts dafür vor, daß der Schuldner auf die Ausübung des Wirtschafts gewerbes verzichten wolle. Und für die Annahme, daß derselbe hiezu gezwungen werden könne, wie der Rekurrent meint, mangelt es an jeder gesetzlichen Handhabe. Im Gegenteil setzt ja das Betreibungsgesetz gerade, um dem Schuldner die weitere Aus übung seines Berufes zu ermöglichen, dem Beschlagsrecht der Gläubiger gewisse Schranken. Mit Recht wurde daher das Pfändungsbegehren abgelehnt und die dagegen erhobene Beschwerde abgewiesen. Demnach hat die Schuldbetreibungs und Konkurskammer erkannt: Der Rekurs wird abgewiesen.
