Karoline Bollag challenged a default judgment entered by the Zurzach peace judge in a flour-price dispute, arguing that she was domiciled in Zurich and could not be sued in Aargau. The Federal Court accepted the Zurich domicile certificate, held the claim to be personal, and confirmed that the constitutional protection of the home forum also applies to solidary debtors. It therefore annulled the cantonal judgment as far as it concerned her. The alleged lack of citation did not need separate examination.
Art. 59 Abs. 1 B.V.; home-domicile venue and solidary debtors. The guarantee of the forum of the defendant’s domicile applies to personal claims and cannot be avoided by joining a solidary debtor domiciled in another canton. If the defendant’s fixed domicile is established, she must be sued there; proceedings brought before another cantonal forum violate the constitutional venue guarantee. Where annulment follows for this reason, further objections—such as defects in citation—need not be examined (consid. 1-2).

Ist aber das angefochtene Urteil, soweit die Rekurrentin betreffend, wegen Verletzung des Art. 59 Abs. 1 cit. aufzuheben, so braucht nicht weiter untersucht zu werden, ob das gleiche auch wegen mangelnder Citation der Beklagten, heutigen Rekurrentin, geschehen müßte. Demnach hat das Bundesgericht erkannt: Der Rekurs wird als begründet erklärt und der Entscheid des Friedensrichterstatthalters des Kreises Zurzach vom 30. Januar 1895 demgemäß, soweit die Rekurrentin betreffend, aufgehoben.
