Joachim Perucchi challenged Bern authorities' decision to apply his CHF 12 payment to costs rather than to the fine. He argued this was an indirect way to preserve pressure for payment of costs and thus circumvent the constitutional ban on debt imprisonment. The Federal Court held that it had competence to examine an alleged constitutional violation, but that no such violation was present yet. No deprivation of liberty had been ordered, and the allocation of the payment itself did not amount to a breach of Article 59(2). The recourse was dismissed.
Art. 59 Abs. 2 BV; Anrechnung einer Teilleistung auf Buße und Kosten; keine Umgehung des Schuldverhaftverbots ohne Freiheitsentziehung. Das Bundesgericht ist zur Prüfung einer behaupteten Verfassungsverletzung zuständig, nicht aber zur abstrakten Kontrolle der kantonalen Regeln über die Zahlungsevidenz. Eine Verletzung von Art. 59 Abs. 2 BV liegt erst nahe, wenn tatsächlich eine Freiheitsentziehung wegen Nichtbezahlung erfolgt oder unmittelbar angeordnet wird; die blosse Anwendung der kantonalen Imputation auf eine Teilzahlung genügt dafür nicht. Eine spätere Verhaftung könnte allenfalls als Umgehung in Frage kommen (consid. 1-2).
Das Bundesgericht zieht in Erwägung:
