Der Bezirksarzt hat die Zurückbehaltung des Beschwerdeführers in der PKKzur Untersuchungangeordnet. Nach § 67d EG ZGB ist eine Einweisung (oder Zurückbehaltung) zur Untersuchung möglich, wenn genügend objektive Anhaltspunkte vorliegen, wonach eine fürsorgerische Freiheitsentziehung überhaupt ernsthaft in Betracht kommt. Im Weiteren ist erforderlich, dass der für die Einweisung zuständigen Behörde noch wesentliche Grundlagen für einen definitiven Einweisungsentscheid fehlen, dass die Klinik über das notwendige Fachwissen verfügt, um die verlangte Untersuchung/Abklärungen vorzunehmen, und dass die Untersuchung nicht ambulant durchgeführt werden kann (AGVE 1983, S. 108 ff.; 1984, S. 216 f.; 1995, S. 248). 2002Fürsorgerische Freiheitsentziehung201 durchgeführt werden (§ 67d Abs. 3 EG ZGB; AGVE 1989, S. 186), das Ergebnis der Untersuchung ist der Einweisungsbehörde sofort mitzuteilen und diese hat darauf unverzüglich entweder die definitive Anstaltsunterbringung zu verfügen oder den Betroffenen zu entlassen (AGVE 1984, S. 217; 1994, S. 351). B. Welche Grundlagen der Einweisungsbehörde noch fehlen, kann nur diese selbst bestimmen. Sie muss deshalb bei einer Einweisung zur Untersuchung genau und eindeutig festhalten, was zu untersuchen bzw. abzuklären ist (AGVE 1994, S. 351). Ohne einen konkreten Abklärungsauftrag an die PKK ist die Einweisung zur Untersuchung unvollständig und muss aus diesem Grund aufgehoben werden. Allerdings ist es sachgerecht, der Einweisungsbehörde zunächst eine kurze Frist zur Verbesserung einzuräumen. C. Zwangsmassnahmen dürfen nur im Rahmen einer fürsorgerischen Freiheitsentziehung angeordnet und vorgenommen werden (§ 67 e bis Abs. 3 EG ZGB). Bei einer Einweisung zur Untersuchung steht gerade noch nicht fest, ob die Voraussetzungen für eine (definitive) fürsorgerische Freiheitsentziehung und damit für eine Zwangsbehandlunggegeben sind. Dies spricht dagegen, Zwangsmassnahmen auch bei einer Einweisung zur Untersuchung als zulässig zu erachten. Vielmehr bleiben die Möglichkeiten der PKK - wie auch sonst, wenn sich Personen in der Klinik befinden, ohne dass bereits eine fürsorgerische Freiheitsentziehung verfügt wurde - auf die Anordnung von Notfallmassnahmen beschränkt. 62 Anstalt; ambulante Behandlung.

  • Der Externe Psychiatrische Dienst (EPD) ist keine Anstalt im Sinne von Art. 397 a Abs. 1 ZGB (Erw. 2 d).
  • Die ambulante, psychiatrische (Nach-)behandlung gestützt auf eine Weisung im Rahmen einer Entlassung aus der FFE ist keine Zwangsmassnahme im Sinne von § 67 e bis EG ZGB (Erw. 2 d).
