Dem ist beizupflichten. Es geht nicht an, den Angeklagten bei einer Ueberbindung der Kosten auf den Anzeiger schlechter zu stellen, als wenn die Kosten auf die Staatskasse genommen werden. Die freigesprochenen Angeklagten sind deshalb nicht auf den Kostenersatz durch den Anzeiger zu verweisen, sondern es ist ihnen die Entschädigung gemäss § 140 Abs. 1 StPO durch den Staat auszurichten, der diese dann gemäss § 140 Abs. 2 StPO seinerseits vom Anzeiger wieder einfordern kann (Urteil des Obergerichts, 3. Die richterliche Anordnung eines Ermittlungsverfahrens bei unbekannter Täterschaft kann nur bei einem schweren Angriff auf die Ehre, den Kredit oder ein anderes Rechtsgut, welches durch die in § 181 Abs. 1 Ziff. 1-6 StPO aufgeführten Gesetzesbestimmungen
