Sintesi Omnilex

The taxpayers, treated as expatriates, sought to deduct reasonable housing costs in Switzerland for May to December 2008. The court held that the rental of their property in India meant they did not have to bear double housing costs. As only the Swiss dwelling had to be financed, Art. 2(2)(b) ExpaV did not allow the deduction. The minor rental income generated in India did not alter this conclusion; the remaining difference was attributable to the higher Swiss price level and was not deductible.

Massima Omnilex

Art. 2 Abs. 2 lit. b ExpaV; deduction of reasonable Swiss housing costs for expatriates requires actual double housing costs. If the foreign dwelling is rented out, the taxpayer bears only the Swiss housing costs; the fact that foreign rental income is lower than Swiss housing expenses does not create a deductible excess, since the difference merely reflects higher local price levels and constitutes non-deductible additional expenditure.

Questione giuridica chiave

Whether reasonable Swiss housing costs were deductible under Art. 2(2)(b) ExpaV for the period May-December 2008.

Decisione estratta

No. Because the property in India was rented out, the taxpayers did not incur double housing costs; only the Swiss dwelling had to be financed, so the deduction was excluded.

Motivazione estratta

The rental income from India did not change the decisive point: the foreign property was not kept as an additional residence, and the difference between Indian rental income and Swiss housing costs reflected non-deductible higher Swiss price levels.
