The complainant challenged a judgment before the Constitutional Court. The Court held that the complainant had been violated in the constitutionally guaranteed right to equal treatment of foreigners under Art. I para. 1 of the Federal Constitutional Law BGBl No. 390/1973. The challenged judgment was set aside. I.Der Beschwerdeführer ist durch das angefochtene Erkenntnis im verfassungsgesetzlich gewährleisteten Recht auf Gleichbehandlung von Fremden untereinander (ArtI Abs1 Bundesverfassungsgesetz, BGBl Nr 390/1973) verletzt worden.
Das Erkenntnis wird aufgehoben.
II.Der Bund (Bundesminister für Inneres) ist schuldig, dem Beschwerdeführer zuhanden seiner Rechtsvertreterin die mit € 3.144,— bestimmten Prozesskosten binnen 14 Tagen bei sonstiger Exekution zu ersetzen.
