TRANSPORTATION (74 PA.C.S.) - AMEND GENERAL AUTHORITY OF DEPARTMENT

                                  AN ACT

     Amending Title 74 (Transportation) of the Pennsylvania
        Consolidated Statutes, further providing for general
        authority of department.

        The General Assembly of the Commonwealth of Pennsylvania
     hereby enacts as follows:

        Section 1.  Section 1307 of Title 74 of the Pennsylvania
     Consolidated Statutes is amended to read:
      § 1307.  General authority of department.
        It is the purpose and intent of this chapter to authorize the
     department to do any and all other things necessary or desirable
     to secure the financial aid or cooperation of any Federal agency
     in any of the department's projects and to do and perform all
     things which may be required by any statute of the United States
     of America or by the lawful requirements of any Federal agency
     authorized to administer any program of Federal aid to
     transportation. The department is expressly permitted to enter
     into protective agreements with labor to the extent required
     under 49 U.S.C. § 5333 (relating to labor standards) in order to
     obtain Federal grant moneys for transportation assistance. Such
     protective agreements shall be narrowly drawn and strictly
     construed to provide no more than the minimum protections
     required by the United States Department of Labor for such
     agreements.
        Section 2.  This act shall take effect in 60 days.
