PARKS AND PARKWAYS, PLANNING IN FIRST AND SECOND CLASS CITIES
                  Act of Jun. 7, 1915, P.L. 894, No. 398 Cl. 11
                                  AN ACT

Relating to and regulating the plotting by cities of the first
class of parks and parkways in built-up sections thereof.

Section 1. Be it enacted, &c., That when a city of the first
class shall hereafter superimpose upon the confirmed plan of
streets of said city any park or parkway, in an entirely built-
up section of said city, the placing of such park or parkway on
the city plan shall be considered as an appropriation to public
use of the land within the lines of said park or parkway, at the
expiration of five years from the date of confirmation of the
plan showing such park or parkway by the board of surveyors of
said city; with the same effect as if the land within the
boundary of said park had been appropriated for public park
purposes, or the said parkway had been opened to public use, by
ordinance of councils, unless an ordinance actually
appropriating said land to public use shall have been previously
passed, or the ordinance placing such park or parkway on the
city plan shall have been previously repealed.
Section 2. Where any park or parkway has been heretofore
superimposed upon the confirmed plan of streets of such city, in
an entirely built-up section, such superimposing shall be an
appropriation for public use of the land within the lines of
said park or parkway, at the expiration of three years from the
     approval of this act.
Section 3. From the date of confirmation of the plan of said
park or parkway, in an entirely built-up section of said city,
until the expiration of said period of five years, or until the
passage of an ordinance to appropriate to public use the land
within the lines of such park or parkway, the owners of said
land may alter their buildings thereon, in accordance with plans
approved by the Bureau of Building Inspection and other
municipal authorities having jurisdiction thereof; and, upon the
assessment of damages for the appropriation of their property to
public use, they shall be entitled to compensation therefor,
including the buildings so altered, computed as of the date of
     said appropriation.
