Ala. Admin. Code r. 630-X-11-.01 Issuance of Limited Teaching Licenses

The Board hereby designates any school of optometry in Alabama approved by the Board as eligible for the issuance of limited teaching licenses to those qualified faculty members performing professional optometric services in programs of the school.

Ala. Admin. Code r. 630-X-11-.02 Issuance of Resident Licenses

Any non-profit school or program of optometric residency approved by the Board is eligible for the issuance of annual resident licenses to those qualified residents enrolled in said school or program. The resident licenses shall be issued in the same manner as limited teaching licenses and shall be subject to the same annual certification by the Dean of the school. Resident Licenses shall be for the limited purpose of performing optometric services only as necessary to participate in and complete the school’s resident program and shall be restricted to the provision of optometric services performed under the supervision of faculty members of the said school possessing a regular or limited teaching license at the time of the provision of services.

Ala. Admin. Code r. 630-X-11-.03 Duties and Responsibilities of Dean

As a condition to continued approval by the Board of this school, the Board imposes the following duties and responsibilities upon the dean of the school relating to those qualified faculty members and residents performing professional optometric services in programs of the school:

a) He or she must annually certify to the Board the names and addresses of the members of the school's faculty and those residents who are not currently licensed to practice optometry in Alabama.

b) He or she shall promptly notify the Board of any changes in personnel on the faculty to whom a limited teaching license has been issued or in the enrollment of any resident to whom a temporary resident license has been issued.

c) He or she must furnish each applicant for a limited teaching license or a resident license a certificate that such applicant is a bona fide member of the faculty of the school or a bona fide resident enrolled in the program.

d) He or she must report immediately to the Board any information received by him relating in any way to a member of the faculty holding only a limited teaching license or a resident holding a resident license who is performing professional optometric services other than as an adjunct to such faculty member's function at the school or such resident’s participation in the program. He or she must also use every reasonable means to prevent such unlawful practice.

e) He or she must otherwise cooperate fully and completely with the Board toward the end that the limited teaching and resident licenses provided hereby will be used only for the purpose for which they are intended.

Ala. Admin. Code r. 630-X-11-.04 Application and Fee for Limited Teaching Licenses or Temporary Resident Licenses

Each member of the faculty or resident student body desiring a limited teaching or resident license as provided for in this chapter shall make written application to the executive director of the Board and attach to his or her application the certificate of the dean hereinabove provided and shall enclose therewith the payment of a fee of One Hundred Dollars ($100.00) for the issuance of the limited teaching license or resident license. There shall be an annual renewal fee, equal to that charged for a regular license, for a limited teaching license or resident license. Said renewal fee shall be due October 1 and delinquent after December 31 of each year. Failure to pay the renewal fee on or before January 1 shall constitute grounds for suspension of said limited teaching license or resident license and license certificate.

Ala. Admin. Code r. 630-X-11-.05 Continuing Education for Limited Teaching Licenseees

Holders of limited teaching licenses shall be required to meet the same continuing education requirements as holders of regular licenses.

Ala. Admin. Code r. 630-X-11-.06 Application for Approval to Use Pharmaceutical Agents

Persons holding a limited teaching or resident license under this chapter may apply to the Board, on a form provided by the Board, for approval to use pharmaceutical agents for the treatment of disease of the eye and its adjacent structures. Such application shall be in the same manner and with the same prerequisites as required for those optometrists licensed prior to October 1, 1994 (630-X-5-.07). Limited teaching or resident license holders so approved shall be subject to the same fees and regulations as holders of regular licenses so approved.

Ala. Admin. Code r. 630-X-11-.07 Validity of Limited Teaching Licenses and Resident Licenses

The limited teaching license provided hereby shall be valid as long as the holder thereof remains a member of the faculty of the school and abides by all regulations of the Board. The temporary resident license provided for in this chapter shall be valid for so long as the holder thereof remains enrolled in the Board approved school or college of optometry.

Ala. Admin. Code r. 630-X-11-.08 Limitation of Limited Teaching Licenses

It shall be a violation of this regulation for the holder of a limited teaching license who is not regularly licensed under the law to perform optometric services in any manner except as part of the program of the school and as an adjunct to his or her teaching functions in the school.

Ala. Admin. Code r. 630-X-11-.09 Forfeiture and Voiding of Limited Licenses, Limited Teaching Licenses, or Resident Licenses

Those persons granted a limited license, limited teaching license, or resident license shall be subject to the same disciplinary procedures as the holder of a regular license. If, after a disciplinary hearing as set out in a previous regulation, a holder of such a license is found to be in violation of the regulations of the Board, then the Board may declare said license forfeited and void. In such an event, the executive director shall promptly notify the licensee and, in the case of a limited teaching or resident license, the Dean of the School of Optometry through which such license was issued.

Ala. Admin. Code r. 630-X-11-.10 Forfeiture and Voiding of Resident Licenses

If a holder of a resident license ceases to be enrolled in the School of Optometry, his or her resident license shall be and is hereby forfeited and declared void. If a holder of a resident license is suspended by the School of Optometry or suffers any other change in status which results in the resident license holder not actively participating in the program, his or her license shall be and is hereby forfeited and declared void. Additionally, those persons granted a resident license shall be subject to the same disciplinary procedures as the holder of a regular license. If, after a disciplinary hearing as set out in these rules, a holder of a temporary license is found to be in violation of § 34-22-6 of the Alabama Code or any other regulation of the Board, then the Board may declare said temporary license forfeited and void. In such an event, the executive director shall promptly notify the licensee and the Dean of the approved school or college of optometry.
