You are hereby notified that the Court has entered the following opinion and order:
2025AP1180-CRNM State of Wisconsin v. Dijon L. Carter (L.C. #2022CF379)
Before Lazar, P.J., Grogan, and LoCoco, JJ.
Summary disposition orders may not be cited in any court of this state as precedent or
authority, except for the limited purposes specified in WIS. STAT. RULE 809.23(3).
Counsel for Dijon L. Carter has filed a no-merit report pursuant to WIS. STAT.
RULE 809.32 (2023-24)1 and Anders v. California, 386 U.S. 738 (1967) concluding that no
grounds exist to challenge Carter’s convictions for three counts of felony bail jumping, with two
of the three counts as acts of domestic abuse. Carter was informed of his right to file a response
to the no-merit report, and he has not responded. Upon our independent review of the Record
and counsel’s report, we conclude there is no arguable merit to any issue that could be raised on

appeal. Therefore, we summarily affirm the judgment of conviction and order denying
postconviction relief. See WIS. STAT. RULE 809.21.
The State charged Carter with two counts of strangulation and suffocation as acts of
domestic abuse; two counts of first-degree recklessly endangering safety; one count of
misdemeanor battery as an act of domestic abuse; one count of obstructing an officer; and nine
counts of felony bail jumping, with three of the counts as acts of domestic abuse. The charges
encompassed a two-day period on October 15, 2022 and October 16, 2022 wherein the State
alleged that Carter was involved in a domestic dispute with the mother of his child, fled from
police at a high rate of speed, and the next day, ran from police. At the time of these alleged
offenses, Carter was released on bond in three Marinette County cases in which he was charged
with various felonies.
In exchange for Carter’s guilty pleas to three counts of felony bail jumping, with two of
the three counts as acts of domestic abuse, the State agreed to recommend that the circuit court
dismiss and read in the remaining counts. The State also agreed to recommend concurrent and
consecutive sentences totaling six years, consisting of three years of initial confinement followed
by three years of extended supervision. Out of a maximum potential sentence of 18 years, the
court imposed concurrent and consecutive sentences resulting in an aggregate ten-year term,
consisting of five years of initial confinement followed by five years of extended supervision.
The court also deemed Carter ineligible for either the challenge incarceration or substance abuse
programs.
No. 2025AP1180-CRNM
3
Carter filed a postconviction motion for sentence modification, arguing that a new factor
justified his eligibility for the substance abuse program. After a hearing, the circuit court denied
the motion, concluding that the new factor did not warrant the sentence modification sought.
The no-merit report addresses whether Carter knowingly, intelligently, and voluntarily
entered his guilty pleas, whether the circuit court properly exercised its sentencing discretion,
and whether there are any grounds to challenge the denial of Carter’s postconviction motion for
sentence modification. Upon reviewing the Record, we agree with counsel’s description,
analysis, and conclusion that any challenge to Carter’s pleas, sentences, or the denial of his
postconviction motion would lack arguable merit. The no-merit report sets forth an adequate
discussion of the potential issues to support the no-merit conclusion, and we need not address
them further. Our independent review of the Record discloses no other potential issue for
appeal.
Upon the foregoing reasons,
IT IS ORDERED that the judgment and order of the circuit court are summarily affirmed.
See WIS. STAT. RULE 809.21.
IT IS FURTHER ORDERED that Attorney Olivia Garman is relieved from further
representing Dijon L. Carter in this appeal. See WIS. STAT. RULE 809.32(3).
IT IS FURTHER ORDERED that this summary disposition order will not be published.
