By order of September 30, 2024, the application for leave to appeal the May 18,
2023 judgment of the Court of Appeals was held in abeyance pending the decisions in
People v Kardasz (Docket No. 165008) and People v Martin (Docket No. 166339). On
order of the Court, Kardasz having been decided on December 19, 2025, ___ Mich ___
(2025), and leave to appeal having been denied in Martin on December 19, 2025, ___ Mich
___ (2025), the application is again considered. It appearing to this Court that the case of
People v Ormsbee (Docket No. 168539) is pending on appeal before this Court and that
the decision in that case may resolve an issue raised in the present application for leave to
appeal, we ORDER that the application be held in abeyance pending the decision in that
case.
