On order of the Court, the application for leave to appeal the August 27, 2025 order
of the Court of Appeals is considered and, pursuant to MCR 7.305(I)(1), in lieu of granting
leave to appeal, we VACATE the October 22, 2024 order of the Macomb Circuit Court
and REMAND this case to that court for reconsideration of the defendant’s motion to
vacate the amended remittance order for attorney fees. In denying the defendant’s motion
by checking a box on a form order, without providing any indication of its reasoning, the
circuit court did not articulate the basis for its decision. On remand, the circuit court shall
decide the motion on the merits in a written decision articulating the reasoning for its
decision.
We do not retain jurisdiction.
