The application for leave to appeal is DENIED for failure to persuade the Court of the need
for immediate appellate review.
Appellant bears “the burden of furnishing . . . a record to verify the factual basis of any
argument upon which reversal [i]s predicated.” People v Elston, 462 Mich 751, 762; 614 NW2d 595
(2000). See also MCR 7.205(E)(1) (providing that, as a general rule, an “application is decided on the
documents filed”); IOP 7.205(B)(1) (“The Court strongly recommends that the appellant file copies of
relevant transcripts and pleadings because the Court does not receive the lower court record when deciding
applications for leave to appeal.”). Moreover, under MCR 7.205(B)(1), an appellant seeking interlocutory
review from this Court bears the burden of “setting forth facts showing how the appellant would suffer
substantial harm by awaiting final judgment before taking an appeal[.]” Appellant, in this case, did not
support this application with a sufficient record on which to convince this Court of the need for immediate
appellate review as it is limited to the transcript of the hearing on Appellant’s partial motion for summary
disposition and the trial court’s order denying the motion.
