Court of Appeals, State of Michigan
ORDER
IN RE LOPEZ
Docket No. 377958
LC No. 25-000000

The motion to waive fees is GRANTED for this case only.
To the extent the complaint seeks a writ of superintending control directed to the 36th
District Court, the complaint for superintending control is DISMISSED for lack of jurisdiction. This
Court has jurisdiction to issue a writ of superintending control “over a lower court or tribunal immediately
below it arising out of an action or proceeding which, when concluded, would result in an order appealable
to the Court of Appeals.” MCR 7.203(C)(1) (emphasis added). The 36 th District Court is not a court
immediately below this Court, and an order of the district court is appealable to the circuit court, not
directly to this Court. Thus, this Court lacks jurisdiction over the complaint to the extent it seeks a writ
of superintending control directed to the 36th District Court.
To the extent the complaint seeks a writ of superintending control directed to the Wayne
Circuit Court, the complaint for superintending control is DENIED.
