The delayed application for leave to appeal is DENIED because defendant has failed to
establish that the trial court erred in denying the motion for relief from judgment. To the extent defendant
claims that three issues raised in the MFRJ were not adjudicated, we note the following. As to Issue 11,
the motion confused matters by seemingly combining this issue with Issue 10, which may have caused
the trial court not to address Issue 11 separately. But in any event, the claim raised in issue 11, concerning
whether defendant was interrogated without being advised of her Miranda rights, see Miranda v Arizona,
384 US 436; 86 S Ct 1602; 16 L Ed 2d 694 (1966), is meritless. The testimony, including defendant’s
own trial testimony, shows that defendant was read her Miranda rights before being subjected to any
custodial interrogation. “[T]he simple asking of a defendant’s name is not interrogation or an investigative
question requiring the issuance of Miranda warnings.” People v Armendarez, 188 Mich App 61, 73; 468
NW2d 893 (1991) (citation omitted). As to Issues 19 and 20, those issues were addressed in the trial
court’s opinion on pages 7 and 8, respectively.
