Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V KIM RICHARDSON
Docket No. 380955
LC No. 2026-001198-FH

The motion for immediate consideration is GRANTED. The motion to file a reply brief is
GRANTED and the brief filed with the motion is accepted.
In lieu of granting the motion to review bail, the Court VACATES the May 28, 2026 order
denying the bond motion and REMANDS to the circuit court for further proceedings consistent with this
order. For the imposition of money bail, a trial court must state reasons on the record to support that “the
defendant’s appearance or the protection of the public cannot otherwise be assured.” MCR 6.106(E). See
also MCR 6.106(C). In deciding what terms and conditions to impose, a trial court is also required to
consider relevant information as detailed in MCR 6.106(F)(1), and to state the reasons for imposing money
bail on the record, MCR 6.106(F)(2). In this case, the circuit court failed to provide any reasons to support
that money bail was warranted under MCR 6.106(E) or to provide any reasons for the imposition of money
bail under MCR 6.106(F). By failing to explain its reasoning, the trial court abused its discretion, see
People v Majeed, 510 Mich 916 (2022), and as a result, the record is inadequate to allow for meaningful
appellate review. On remand, the trial court shall reconsider defendant’s bond motion and state reasons
for its decision on the record as required by MCR 6.106(E) and (F).
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
