In lieu of granting the delayed application for leave to appeal, the January 7, 2026 order of
the 4th Circuit Court is VACATED, and this matter is REMANDED to the circuit court for entry of an
order remanding this matter to the 12th District Court for a continuation of the preliminary examination,
including a determination whether the evidence presented at the preliminary examination was sufficient,
by a preponderance of the evidence, to establish the corpus of the crime charged in light of People v
Tadgerson, ___ Mich ___, ___; ___ NW3d ___ (2025). MCR 7.205(E)(2); People v Stephens, 480 Mich
1035, 1035-1036; 743 NW2d 564 (2008). The district court may reopen proofs upon request of either
party.
This order has immediate effect. MCR 7.215(F)(2). The Court does not retain jurisdiction.
