Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V WILLIAM ROGER HILL
Docket No. 370058
LC No. 03-011262-01-FC

On September 26, 2025, the Supreme Court vacated this Court’s August 5, 2024 order and
remanded this matter for reconsideration of the delayed application for leave to appeal in light of an error
in this Court’s prior order denying the application. Having reconsidered the matter:
The motion to waive fees is GRANTED for this case only.
The delayed application for leave to appeal is DENIED for lack of merit in the grounds
presented. While the order denying defendant’s application for delayed appeal in Docket No. 262551
does not specifically include “lack of merit” language, that application was taken from the judgment of
sentence, a final order. The application was filed by appointed counsel, and this Court also accepted a
supplemental Standard 4 brief raising additional issues. This Court’s order resolving that application
granted relief as to one issue raised by counsel, and denied the balance of the application. There is no
doubt that defendant received appellate review of his judgment of sentence in Docket No. 262551. The
trial court thus reached the correct result by denying the motion to restore appellate rights. People v Byars,
346 Mich App 554, 568-569; 13 NW3d 328 (2023); People v Tardy, 348 Mich App 500; 19 NW3d 164
(2023).
