The confession of error is REJECTED. In the confession of error, plaintiff states that
defendant “is entitled to resentencing because the trial court based its departure sentence in part on
[defendant’s] admission that he had committed the same crimes against other corporations.” This is not,
however, a basis for resentencing that has been specifically argued by defendant. Furthermore, the
confession of error does not address defendant’s arguments regarding the trial court’s reasons for the
departure sentence.
The motion for peremptory reversal pursuant to MCR 7.211(C)(4) is DENIED for failure
to persuade the Court of the existence of manifest error requiring reversal and warranting peremptory
relief without argument or formal submission.
This case shall be submitted for decision through the ordinary processes of this Court, and
the confession of error shall be submitted to the case call panel assigned to decide the case. MCR
7.211(C)(7).
