Court of Appeals, State of Michigan
ORDER
KARINA MARIA BARAJAS-BRAZIL V DELANO MICHAEL DAILY JR
Docket No. 379088
LC No. 18-007789-DS
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is GRANTED for this appeal only.
The claim of appeal is DISMISSED for lack of jurisdiction because the January 5, 2026
order denying reconsideration is not a final order appealable by right. Nye v Gable, Nelson & Murphy,
169 Mich App 411, 415; 425 NW2d 797 (1988). While the order states that it “is a final order which
resolves the last remaining issue pending before the court,” this statement is not controlling for purposes
of this Court’s jurisdiction. Faircloth v Family Independence Agency, 232 Mich App 391, 400; 591 NW2d
314 (1998). Additionally, neither the October 6, 2025 postjudgment child support modification order nor
the December 12, 2025 order, which denied an objection to the October 6, 2025 order, are final orders
appealable by right. MCR 7.203(A)(1); MCR 7.202(6). Dismissal is without prejudice to the filing of a
late application for leave to appeal the orders under MCR 7.205(A)(4), provided such a filing meets all
requirements under the court rules and is not time-barred.
