Pursuant to MCR 7.211(C)(4) and MCR 7.205(E)(2), and in lieu of granting the application
for leave to appeal, we VACATE in part the January 6, 2026 order of the trial court and REMAND in part
for reconsideration. On remand, the trial court shall reconsider: (1) whether a parole detainer was in fact
filed and whether defendant is entitled to jail credit consistent with People v Allen, 507 Mich 597; 968
NW2d 532 (2021), and People v Idziak, 484 Mich 549; 773 NW2d 616 (2009); (2) whether the court
would impose a materially different sentence in light of the advisory nature of the sentencing guidelines,
see People v Steanhouse, 500 Mich 453, 462; 902 NW2d 327 (2017); People v Howard, 323 Mich App
239, 253; 916 NW2d 654 (2018); and (3) whether the record supports the scoring of offense variable 16.
The “Motion to Accept In Propria Persona Motion” is GRANTED, and immediate
consideration of defendant’s pro se motion is GRANTED.
Defendant’s pro se motion for peremptory reversal is DENIED as moot in light of this
Court’s remand order directing the trial court to reconsider the jail credit issue.
In all other respects the application is DENIED for lack of merit in the grounds presented.
The trial court shall render its decision on remand within 56 days of the Clerk’s certification
of this order. We do not retain jurisdiction.
