Defendant’s motion for immediate consideration is GRANTED. Defendant’s motion for
leave to amend the answer to the application is GRANTED, and the amended answer submitted with the
motion is accepted for filing. The prosecutor’s motion to amend the application is GRANTED, and the
amended application submitted with the motion is accepted for filing.
The application for leave to appeal is considered, and it is DENIED. We deny the
prosecutor’s request for leave to appeal for failure to persuade based largely on the prosecutor’s failure to
make available to us the SANE report it sought to introduce below, making problematic our review of
circumstances giving rise to the report even when considering the testimony elicited of the SANE nurse.
As the matter is now concluded in this Court, the stay directed by this Court in its February 9, 2026 order
is no longer in effect, and proceedings may continue in the trial court.
