Court of Appeals, State of Michigan
ORDER
IN RE MCDOWELL MINORS
Docket No. 375819
LC No. 2018-000939-NA
Christopher M. Murray

On the Court’s own motion, the appellant’s brief is STRICKEN for failure to conform to
MCR 7.212. In particular, MCR 7.212(6) requires the statement of facts to include a “clear, concise, and
chronological narrative” containing “[a]ll material facts, both favorable and unfavorable” with “specific
page references to the transcript, the pleadings, or other document or paper filed with the trial court.”
Appellant’s two-sentence statement of facts is wholly deficient under MCR 7.212(6). Appellant’s two-
paragraph argument is also deficient. See Riemer v Johnson, 311 Mich App 632, 653; 876 NW2d 279
(2015) (“It is not enough for an appellant in his brief simply to announce a position or assert an error and
then leave it up to this Court to discover and rationalize the basis for his claims, or unravel and elaborate
for him his arguments, and then search for authority either to sustain or reject his position.” (Quotation
marks and citation omitted.))
Within 14 days of the date of the order, appellant’s counsel, Malita Barrett (P 43238)
shall file a conforming brief with this Court. Failure to file a conforming brief may result in the remand
of this case to the trial court for appointment of new counsel. Future deficient filings by appellant’s
counsel may result in monetary sanctions personal to counsel or further action by this Court.
