Michael F. Gadola, Chief Judge, acting under MCR 7.217 and MCR 7.219(J), orders:
The motion for reinstatement of appeal is GRANTED. This appeal is REINSTATED.
Also, appellants’ brief may be timely filed within 21 days after the date of this order.
Further, in light of counsel’s indication that he will personally bear the filing fee for the
present motion without passing the fee on to appellants, the $250 in costs assessed in the order of June 26,
2026 against Stuart Sandweiss (P60921), retained counsel for appellants, is VACATED. However,
contrary to the indication of the motion, the Clerk’s Office did email appellants’ counsel a warning letter
for the overdue docketing statement by on May 21, 2026. And the Clerk’s Office sent a follow-up email
to him regarding that warning letter on June 15, 2026. The Court accepts counsel’s good faith in
effectively indicating that he did not receive those emails, but he may wish to verify that there is not a
problem with his e-mail system.
