Court of Appeals, State of Michigan
ORDER
IN RE TJ
Docket No. 379797
LC No. 25-001077-MI
Michael J. Kelly
Presiding Judge
Christopher M. Trebilcock
Andrew J. Lievense
Judges
The motion to remand is DENIED for failure to persuade the Court of the necessity of a
remand at this time. Respondent has not complied with the court rule requirement that an individual
bringing a motion to remand must file an affidavit or offer proof “regarding the facts to be established at
a hearing.” MCR 7.211(C)(1)(a). Though terming nine assertions in his motion to remand his “offer of
proof,” these assertions are not statements of the facts he would prove at a hearing. Instead, they are
simply repetitions of the claims respondent is making in his motion and brief on appeal or citations from
the existing record.
Denial of remand is without prejudice to a case call panel of this Court determining that
remand is necessary once the case is submitted on a session calendar.
