The motion for immediate consideration is GRANTED.
The motion for peremptory reversal pursuant to MCR 7.211(C)(4) is GRANTED for the
reason that the trial court erred by summarily dismissing the praecipe for defendant’s application to set
aside her conviction without making the findings required by MCL 780.621d(13), as conceded by the
prosecutor.
The order dismissing the praecipe is REVERSED and the cause is remanded for
reconsideration of the application to set aside defendant’s conviction.
We do not retain jurisdiction.
