Mark T. Boonstra, Judge, acting under MCR 7.217 and MCR 7.219(J), orders:
The motion for reconsideration of this Court’s May 19, 2026 order is GRANTED IN
PART.
The Court VACATES the part of its May 19, 2026 order which remanded this matter to
the trial court for the appointment of substitute counsel, the appellant’s brief having been filed.
The Court orders that the $250 in costs assessed against Richard Catalino (P39516),
appointed counsel for appellant, are REAFFIRMED. Such costs are personal to the attorney and shall not
be charged back to the County or to the State.
The Court further orders that the time for filing the appellee’s brief under
MCR 7.212(A)(2)(a) shall be calculated from the date of the Clerk’s certification of this order.
