Court of Appeals, State of Michigan
ORDER
DAVID H AHONEN & RUTH C AHONEN TRUST V JULIE THOMSEN
Docket No. 378745
LC No. 2024-000809-CZ
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The “fee waiver request” is treated as a motion to waive fees and is GRANTED for this
appeal only.
The claim of appeal is DISMISSED IN PART for lack of jurisdiction as to the December
8, 2025 “ex parte order denying petitioner’s motions and sanction for violation of MCR 1.109.” The order
was a postjudgment order entered in a civil action commenced in probate court, and it does not meet the
definition of a final order as set forth in MCR 7.202(6)(a). Therefore, the order was not appealable by
right. MCR 5.801(A)(1). The claim of appeal remains pending as to the December 8, 2025 order granting
“motion for costs and attorney fees,” which is defined as a final order in MCR 7.202(6)(a)(iv). MCR
5.801(A).
This order is entered without prejudice to appellant filing an application for leave to appeal
the December 8, 2025 “ex parte order denying petitioner’s motions and sanction for violation of MCR
1.109,” provided the filing meets all requirements under the court rules and is not time-barred.
