The motion to waive fees is GRANTED for this appeal only.
The claim of appeal is DISMISSED for lack of jurisdiction. MCR 7.203(A)(1). The
December 15, 2025 circuit court order is not a final order as defined in MCR 7.202(6)(a). More
specifically, the order is not a general final order, MCR 7.202(6)(a)(i), because issues related to the
partition of property, MCL 600.3407, remained pending after entry of the order. Appellant’s reliance on
the probate court rules as a basis for this Court’s jurisdiction over this appeal from the December 15, 2025
order is misplaced. MCR 7.203(A)(1); MCR 5.801(A)(1). Dismissal is without prejudice to the filing of
a late appeal from the December 15, 2025 order under MCR 7.205(A)(4), provided such a filing meets all
requirements under the court rules and is not time-barred.
