The motion for immediate consideration is GRANTED.
Pursuant to MCR 7.211(C)(4) and MCR 7.205(E)(2), and in lieu of granting the application
for leave to appeal, we PEREMPTORILY REVERSE the April 9, 2026 order of the circuit court and
REMAND for the court to consider plaintiff’s request in accordance with MCR 6.107. While some of the
concerns cited in this Court’s prior decision resolving a similar request made by plaintiff might still be
relevant to plaintiff’s request in this case, the circuit court’s decision on remand should be guided by MCR
6.107, as opposed to this Court’s prior decision that denied a different request made by plaintiff under
different circumstances.
We do not retain jurisdiction.
