Court of Appeals, State of Michigan
ORDER
TERI NICOLE BROCK V LANCE RICHARD WINTER
Docket No. 378733
LC No. 2023-518412-DP
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is GRANTED for this case only.
The claim of appeal is DISMISSED for lack of jurisdiction because the December 18, 2025
order appealed from is not a final order as defined in MCR 7.202(6). MCR 7.203(A)(1). The
postjudgment order dismissing plaintiff’s motions to reinstate the case and motion for “ex parte immediate
return of minor child” cannot be considered an order that grants or denies a motion to change legal custody,
physical custody, or domicile under MCR 7.202(6)(a)(iii). Dismissal is without prejudice to the filing of
a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules
and is not time-barred.
Given that this Court lacks jurisdiction over this appeal, the motion for peremptory reversal
is DISMISSED.
